User Agreement

1. Introduction and Agreement to Terms

Please read these terms of service carefully. This is a binding contract between you (the “User”) and Watford eSports Platform (“WSP”) for all services operated by Watford eSports and those provided in partnership with Rival Sports (“Rival”).

When using the services provided by WSP, you will be subject to the Terms and Conditions and to any and all additional guidelines, rules or terms and conditions that are posted on the services, made available to you, or disclosed to you in connection with specific services.

You agree that by clicking “sign up” or otherwise registering, accessing, or using services provided by WSP, you are entering into a legally binding agreement between you and WSP regarding your use of these services. You acknowledge that you have read, understood, and agree to be bound by these terms of service. 

If you do not agree to these terms of service, do not access, or otherwise use, any WSP services.

 

2. Privacy Notice and Friends List Access

Your privacy is important to WSP. Please see both the WSP and Rival privacy notices for information relating to how we collect, use, and disclose your personal information, and for advice on how you can manage your online privacy when you using WSP services.

The WSP and Rival Chatrooms are monitored and stored to protect our Users. For WSP’s Guidelines on adding, removing, and interacting with other Users, read our Best Practice notice.


        a. Xbox Friends List 

Within any tournaments and competitions held by WSP in partnership with Rival, if you are using an Xbox console, the gamertag of your opponent will automatically be added to your “FRIENDS” list on a temporary basis. Upon completion of the game, the inserted gamertag will automatically be removed from your FRIENDS list.

This functionality is possible by virtue of Rival’s relationship with Microsoft and Rival will only utilise this capability when two Users are matched up to play on Rival.

        b. PlayStation Friends List

WSP and Rival are unable to insert opponents’ gamertags into the Friends List of Users playing on a PlayStation console. The process must be done manually by the User, on the console itself, once they have been matched up with their opponent.

 

3. User Accounts

 

        a. Age Requirement

It is prohibited for persons under the age of 13 to use WSP services. By creating an account, signing up to tournaments, or otherwise using WSP services, you represent that you are at least 13 years of age.

If you are between the age of 13 to 16 years, you must obtain consent from a parent or legal guardian before signing-up to the Watford eSports Platform and all tournaments affiliated with the platform. 

If you are the parent or legal guardian of a child under 16 who has become a member of WSP without your consent, then please contact WSP administrators at esports@watfordfc.com with proof of the child’s age, to have that account terminated and the child’s personal information deleted promptly, in compliance with the law.

b. Blocked Persons

WSP services are not available to any Users previously removed from the Platform services (“Blocked Persons”). 

By creating an account, signing up to tournaments, or otherwise using WSP services, you represent that you have not previously been removed from and are thus prohibited from making use of WSP services.

Registering for a new account under a different email, credentials, or alias will be considered a breach of this term of use and any User suspected to have done so will have their account suspended. WSP reserves the right to terminate accounts found to be registered to a Blocked Person.

        c. Account and Password

You are solely responsible for maintaining the confidentiality of your account, your password and for restricting access to your console. You may not sell, lease, share, or provide access to your account to anyone else. 

If you breach this term of use, you will be held to have agreed to WSP terms & conditions and this User Agreement on behalf of all other persons who use the services under your account or password, and you are responsible for all activities that occur under your account or password. 

WSP reserves all available legal rights and remedies to prevent unauthorised use of Watford eSports services.

 

4. Prohibited User Conduct

You agree to comply with the terms and conditions of WSP.

You agree not to violate any law, contract, intellectual property rights or other third-party right, and not to commit a tort. You agree that you are solely responsible for your conduct on the WSP.

Further, you agree not to harvest, collect, or share the contact information of other Users, or to harass, abuse, or threaten other Users. WSP reserves the right to determine whether a User’s actions amount to a breach of this term.

You agree not to conduct yourself in such a manner that is in violation of any National, or International law or regulation, including without limitation laws governing intellectual property and other proprietary rights, data protection, and privacy.

To the extent permitted by the law, WSP takes no responsibility and assumes no liability for any User conduct or for any loss or damage resulting therefrom, nor is WSP liable for any mistakes, omissions, falsehoods, obscenity, pornography, or profanity you may encounter when using the services.

 

5. Indemnification

To the fullest extent permitted by applicable law, you agree to be liable to WSP, Rival Sports, and each of our respective contractors, employees, officers, directors, agents, licensors, and partners (individually and collectively, the “WSP parties”) for any claims, losses, damages, demands, expenses, costs, and liabilities, including legal fees and expenses, arising out of or related to your access, use, or misuse of WSP services, any content you post or otherwise transmit through WSP services, your violation of the rights of any third party, any violation by you of the terms of this User Agreement, or any breach of the representations, warranties, and covenants made by you herein. 

 

Best Practice Guidelines

Adding Friends on PlayStation consoles:

  • Do not accept invitations from any Player who is not your opponent.
  • Delete your opponent from your Friends List once the match-up has been completed and your scores have been submitted.

PlayStation and/or Xbox Party Chat:

  • Do not add your opponent or any other Player to the Party Chat function.
  • Do not accept any Party Chat invitations from either your opponent or any other Player.

Watford eSports Platform Chat:

  • Do not share any personal information on the Chatroom functionality.
  • Do not take any conversations offline or to any other platform or medium.
  • If you feel uncomfortable or threatened within the Chatroom, please report the matter to the Watford eSports Platform administrators.
